All property does not have to go through probate when a person dies. When we’re helping clients with their estate plans, one of our objectives is to avoid probate upon death. By transferring your assets to a trust you can avoid probate. After your death your trustee would step in without any court intervention, and distribute the assets according to the terms that you set out in the trust. Probate can be very expensive and very costly, so we help our clients avoid it by setting up a trust.
