What happens if the personal representative fails to perform his or her duty?

If a personal representative fails to perform his or her duties, then the beneficiaries of the estate must get involved in the probate proceedings. They can ask the court to either compel the personal representative to fulfill their fiduciary duties, or if the breaches of the fiduciary duty are egregious enough, they can ask the court to remove the personal representative.
